INTERVIEWThe Paris court renders its judgment on Monday in the river trial of the Mediator health scandal, more than ten years after the opening of a first judicial investigation following revelations on the toxicity of this drug, used in the treatment of diabetes type 2. Prescribed to some five million people for more than thirty years, the Mediator, which can cause arterial hypertension and valve disease, was not withdrawn from the market until November 2009. The prosecution notably requested 10 million euros in fines against several companies belonging to the Servier group, which marketed this product. But also five years in prison, including three closed, and a 200,000 euros fine for Jean-Philippe Seta, former right-hand man of Jacques Servier, the founder of the laboratories of the same name, who died in 2014.

“Our victims are waiting for their status as victims of the Mediator to be definitively identified and recognized by the condemnation of the laboratories”, declared Sunday, at the microphone of Europe Midi, Jean-Christophe Coubris, lawyer specializing in bodily injury and medical errors, in first line in this river trial since it represented more than 2,500 victims. “This condemnation, I cannot believe that the laboratories will escape it as the file clearly demonstrated this incredible desire to keep this product on the market at all costs, even though it was dangerous and they could not. ignore “, explains Jean-Christophe Coubris.

“So far, no jurisdiction has severely condemned any laboratory whatsoever”

“We also hope that the court will take into account the suffering of the victims. I hope that the compensation will be fair compensation”, adds the lawyer, while nearly a billion euros has been claimed by the all the victims. “These laboratories, so that they hear reason, so that they understand, I believe that we have no other solution than a judgment which will sanction them financially,” he maintains. “This will be new because so far no jurisdiction has severely condemned any laboratory.”

In the eyes of this lawyer, the Mediator scandal marks a breaking point in the relationship between the pharmaceutical industry and the French health system. “The medical profession was, I think, blinded by the attitude of the laboratories. We have a system which worked in reverse. The doctors were trained by the laboratories which themselves did not have a very objective discourse, but rather commercial so that manufactured drugs are sold by these same doctors “, analyzes Jean-Christophe Coubris. “It is a situation that has definitely lived through because of this earthquake that was the Mediator.”
