The Government takes to the Constitutional various articles of the decree of the Minimum Vital Income of the Executive


The Generalitat of Catalonia has approved this Tuesday to file an unconstitutionality appeal against different articles of the Royal Decree law creating the Minimum Vital Income (IMV) of the Government, after the Council of Statutory Guarantees (CGE) has concluded that they violate powers of the Statute.

In a telematic press conference after the Executive Council, the acting Government spokesperson, Meritxell Budó, explained that the negotiations with the Government did not allow an agreement to be reached, and therefore they have decided to file said appeal given that the deadline to be able to do so ends on March 3.

It has also specified that the decision to present this appeal will not have “No negative impact on citizens because it does not stop the management of the benefit.”

According to Budó, the Statute regulates competition “exclusive” of the Generalitat in matters of social services, such as the regulation and organization of the activity of social services, technical benefits and economic benefits with welfare or complementary purpose of other public welfare systems.

It has also claimed that Catalonia has exclusive competence in the field of social benefits, for which they consider that the IMV it must be coordinated with the social protection system of Catalonia and with the Guaranteed Citizen Income.

Criticism of the Government

“With the decree law, the Government alters the framework of action of the social services network of Catalonia by partially modifying the structure with which the social inclusion policies and the consensus that have been developed in Catalonia on this issue are applied“, has underlined.

Thus, Budó has accused the Government of taking “a false step by ignoring that the Statute establishes that the Government recognizes and exclusively manages non-contributory pensions“.
